Coaching is a collaborative process intended to encourage reflection, build awareness, explore opportunities and support personal and professional development.
Challenge Your Thinking is committed to providing a professional, respectful and supportive coaching environment.
Clients acknowledge that:
· Coaching requires their active participation, openness and commitment.
· They remain responsible for their own decisions, actions and outcomes.
· Coaching may involve exploring assumptions, beliefs, behaviours and perspectives.
· Progress and outcomes will vary according to individual circumstances and participation.
· No specific personal, professional or financial outcome is guaranteed.
Our role is to facilitate learning, growth and development rather than make decisions on behalf of clients.
Coaching, training and facilitation services are intended for personal and professional development.
Unless expressly agreed otherwise and supported by appropriate professional qualifications, our services do not constitute psychological treatment, counselling, medical advice, legal advice or financial advice.
Clients should seek advice from appropriately qualified professionals where required.
If circumstances arise during coaching that indicate specialist professional assistance may be beneficial, Challenge Your Thinking may recommend that the client seek additional support.
Bookings may be made through our website, email, telephone or other agreed arrangements.
A booking is confirmed when Challenge Your Thinking provides written confirmation or when the booking is otherwise accepted through an agreed booking process.
For corporate training, facilitation and customised programs, a written proposal or agreement may be required before services commence.
Where a proposal, contract or agreement specifies a payment milestone upon acceptance or signing, the corresponding invoice may be issued at that time in accordance with the agreed payment terms.
Fees for coaching, mentoring, training, workshops, professional speaking and facilitation services will be agreed with the client before services commence.
Unless otherwise agreed in writing:
· All fees are quoted in Australian dollars.
· GST will be identified where applicable.
· Payment arrangements will be specified in the relevant proposal, quotation, contract, agreement or invoice.
· Fees may be invoiced upon acceptance or signing of an agreement, at agreed project milestones, periodically throughout an engagement, or following delivery of services.
· Where milestone payments apply, the relevant milestones, amounts and payment terms will be agreed in advance.
· Additional expenses, including travel, accommodation, venue hire or specialist materials, will be agreed with the client in advance.
Invoices are payable by the due date specified on the invoice or as otherwise agreed in writing.
Where payment is overdue, Challenge Your Thinking may, following reasonable written notice, suspend or defer further services until outstanding payments are resolved, subject to applicable law and contractual obligations.
Any changes to agreed fees, payment milestones or invoicing arrangements will be confirmed in writing between the parties.
We understand that circumstances change and aim to provide reasonable flexibility.
The following standard arrangements apply unless otherwise agreed in writing:
· More than 48 hours’ notice: Clients may reschedule a coaching session without additional charge, subject to availability.
· Between 24 and 48 hours’ notice: Rescheduling may be offered at our discretion.
· Less than 24 hours’ notice: The session fee may be charged or the session counted as used.
· Non-attendance: Where a client does not attend a scheduled session without prior notification, the session may be treated as completed.
Where Challenge Your Thinking needs to reschedule a session, an alternative mutually convenient time will be offered. If an alternative cannot be agreed, the client may request a refund for the affected service.
These arrangements do not limit any rights or remedies available under the Australian Consumer Law.
Corporate workshops, training programs and facilitation engagements often involve significant preparation, scheduling and resource commitments.
Unless otherwise agreed in a written proposal, the following cancellation arrangements apply:
· More than 14 calendar days before delivery: No cancellation fee, other than reasonable, documented and non-recoverable expenses already incurred.
· 7–14 calendar days before delivery: A cancellation fee of up to 25% of the agreed service fee may apply.
· Less than 7 calendar days before delivery: A cancellation fee of up to 50% of the agreed service fee may apply.
Any cancellation fee will reflect the circumstances of the engagement, including preparation completed, costs incurred, resources committed and the ability to mitigate losses. Cancellation fees will not exceed reasonable costs and losses associated with the cancellation.
Requests to reschedule will be considered in good faith, taking account of availability and commitments already made.
Where Challenge Your Thinking cancels an engagement, the client will be offered an alternative date or a refund for services not delivered, as appropriate.
Nothing in this section limits applicable statutory rights.
Challenge Your Thinking recognises that trust and confidentiality are essential to effective coaching and facilitation.
Information shared during individual coaching sessions will be treated confidentially, except where:
· Disclosure is required or authorised by law.
· There is a serious threat to the health, safety or wellbeing of an individual and disclosure is legally permitted or required.
· The client provides informed consent for specified information to be shared.
· Disclosure is otherwise permitted under an applicable written agreement or law.
Where coaching is funded by an employer or organisation, the nature of any reporting or feedback to the sponsoring organisation will be agreed in advance.
Individual coaching discussions will not ordinarily be disclosed to employers or sponsors without the client’s consent, except as described above.
For group coaching and workshops, participants are encouraged to respect the confidentiality of information shared by others. However, Challenge Your Thinking cannot guarantee the conduct of other participants.
Challenge Your Thinking respects the privacy of clients and participants.
Personal information collected in connection with our services will be handled responsibly and in accordance with applicable Australian privacy laws.

Clients and participants are granted a limited, non-exclusive, non-transferable licence to use materials supplied to them for their own personal or internal organisational learning and development.
Materials must not be reproduced, distributed, published, commercially exploited or used to deliver training to others without prior written permission, except where permitted by law or a separate agreement.
Clients retain ownership of materials and intellectual property they provide to Challenge Your Thinking.
We are committed to providing a respectful, inclusive and professional learning environment.
Participants are expected to:
· Treat others with dignity and respect.
· Contribute constructively to discussions and activities.
· Respect the confidentiality and perspectives of other participants.

Challenge Your Thinking reserves the right to take reasonable steps to address conduct that compromises the safety, wellbeing or learning experience of others, including removing a participant from an activity where necessary.
Any consequences for fees or refunds will be determined reasonably and in accordance with applicable law.
Where services are delivered online, participants are responsible for ensuring they have suitable internet access, equipment and an appropriate environment for participation.
Challenge Your Thinking will take reasonable steps to deliver online services effectively but cannot guarantee uninterrupted access to third-party technology platforms.
Where technical difficulties materially affect delivery, reasonable arrangements will be made to reschedule or provide an alternative, subject to applicable consumer rights.
Sessions must not be recorded, photographed or distributed without prior agreement from Challenge Your Thinking and, where relevant, the other participants.
Challenge Your Thinking will provide services with due care and skill and in accordance with applicable legal obligations.
Coaching, training and facilitation outcomes depend on a range of factors, including individual circumstances, participation, organisational environments and the implementation of learning.
While we are committed to delivering high-quality services, we do not guarantee particular results.
To the extent permitted by law, Challenge Your Thinking is not responsible for decisions independently made by clients or participants based on their interpretation or application of information provided during services.
Nothing in these Terms and Conditions excludes, restricts or modifies rights, guarantees or remedies that cannot lawfully be excluded, including those under the Australian Consumer Law.
From time to time, reasonable adjustments to the format, content, timing or delivery arrangements of services may be necessary.
Any material changes to confirmed services will be discussed with affected clients, and agreement will be sought where appropriate.
Where a material change cannot be agreed, clients will retain any applicable rights to cancel or obtain a refund.
Neither party will be responsible for delays or failures to perform obligations caused by circumstances beyond their reasonable control, to the extent permitted by law.
Such circumstances may include natural disasters, serious illness, government restrictions, significant infrastructure disruptions or other unforeseen events.
Both parties agree to communicate promptly and work in good faith to identify reasonable alternative arrangements.
This provision does not remove any rights or remedies available under applicable law.
Challenge Your Thinking is committed to addressing concerns professionally, respectfully and promptly.
Clients are encouraged to contact us directly if they have concerns about any aspect of our services.
We will endeavour to resolve complaints through open communication and good-faith discussion.
Where a dispute cannot be resolved directly, either party may seek independent advice or pursue available legal remedies.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
Clients may be entitled to remedies where services do not meet applicable consumer guarantees, including where services are not provided with due care and skill.
Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights or remedies available under the Australian Consumer Law or other applicable legislation.
These Terms and Conditions are governed by the laws of the Australian Capital Territory, Australia, and applicable Commonwealth legislation.
The parties submit to the jurisdiction of the courts of the Australian Capital Territory, subject to any mandatory legal requirements.
Challenge Your Thinking may update these Terms and Conditions from time to time.
The version applicable to a confirmed engagement will generally be the version agreed at the time of booking, unless the parties subsequently agree otherwise or a change is required by law.
The current version will be available on our website.
